These Terms of Service ("Terms") govern your access to and use of the Arêthlete platform, products, and services ("Services") operated by Arêthlete ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.
Acceptance of Terms
By creating an account, accessing, or using any part of the Services, you confirm that you are at least 18 years of age, have read and understood these Terms, and agree to be legally bound by them. If you do not agree, you may not use the Services.
Description of Services
Arêthlete provides AI-powered performance coaching, content management, and analytics tools for athletes, musicians, executives, and individuals seeking peak performance. Services may include, but are not limited to:
- AI coaching systems (GIO, FORMA, LUCID, AURYN, ENSŌTÉ, ARETÉ)
- Performance tracking and analytics
- Content publishing and scheduling tools
- Community access and resources
User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to terminate accounts that violate these Terms.
Acceptable Use
You agree not to use the Services to:
- Violate any applicable laws or regulations
- Infringe on the intellectual property rights of others
- Transmit harmful, offensive, or unauthorized content
- Reverse engineer, copy, or resell any part of the Services
- Interfere with or disrupt the integrity or performance of the Services
Intellectual Property
All content, features, and functionality of the Services — including but not limited to AI models, coaching frameworks, software, text, graphics, and logos — are the exclusive property of Arêthlete and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.
User Content
By submitting content to the Services, you grant Arêthlete a non-exclusive, royalty-free, worldwide license to use, store, and process that content solely for the purpose of providing and improving the Services. You retain ownership of your content.
Third-Party Integrations
The Services may connect to third-party platforms including Meta, TikTok, YouTube, and Google. Your use of those platforms is governed by their respective terms of service. Arêthlete is not responsible for the practices or content of third-party services.
Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or meet your specific requirements. AI coaching outputs are informational and not a substitute for professional medical, psychological, or legal advice.
Limitation of Liability
To the fullest extent permitted by law, Arêthlete shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability shall not exceed the amount you paid us in the three months preceding the claim.
Termination
We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, with or without notice. Upon termination, your right to use the Services will immediately cease.
Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the new Terms on this page with an updated effective date. Continued use of the Services after changes constitutes acceptance of the new Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Los Angeles County, California.
